Terms of Use

The below terms and conditions govern your access to and use of the Gutwein Law website (the “Website”), including any content, functionality, and services offered on or through the same. The Website is offered by Gutwein Law LLP, an Indiana limited liability partnership.

Please read this policy (the “Policy”) carefully to understand our policies regarding information we obtain about you. By accessing or using the Website, you agree to this Policy.

Please note that if you are a client of our law firm under a written engagement letter, information obtained through such representation may be subject to different terms or protected in ways not covered by this Policy (for example, professional duties of confidentiality, attorney-client privilege, and other legal privileges or protections).

  1. General. The Website may contain attorney advertising material. To the extent the Website provides information regarding our historical or representative work, such details are for information only and do not guarantee that we would be able to represent you, or successfully assist you regarding any claim or transaction, even in similar matters. Each legal matter is unique, and prior results are not necessarily representative of all our matters. You are not a client of our law firm unless you have executed a written engagement letter with Gutwein Law, and we have no obligation to offer representation to any individual or entity.
  2. Changes. We reserve the right to change this Policy at any time. Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by means of posting a notification on the Website or by other means if required by law. We may make non-substantive updates or clarify existing provisions without notifying you. Your continued use of the Website after such modifications will constitute your acknowledgment of the modified Policy and you agree to be bound by the modified Policy.
  3. The Information We Collect and How We Collect Information.
    1. We collect information that identifies, relates to, or could reasonably be linked to you or your household (“Personal Information”) when you provide it to us. For example, we collect Personal Information when you submit an inquiry through any contact form, or when you reach out to us via any email address or other contact information listed on our Website. The information we collect may include your name, address, email address, phone number, and includes any other Personal Information that you provide to us.
    2. We may also collect information regarding how the Website is accessed and used by users of the Website, including but not limited to access times and the pages of our Website that you visit, along with the time spent on those pages, and/or your queries or searches completed on the Website (collectively, “Usage Data”). Usage Data is collected for every User of the Website. We may associate Usage Data with a unique identifier or with other information about you in our internal systems. Usage Data may be collected automatically as you navigate through the Website.
    3. We also collect Personal Information that may be classified as “sensitive” under certain laws when you apply for a job with our firm.
  4. How We Use Your Information. We may use your information in the manners set forth below. In this Policy, the term “information” includes any information we collect or obtain about you, including Personal Information and Usage Data, unless otherwise specified.
    1. If you submit an inquiry through a contact form or otherwise contact us using a method listed on the Website, a member of our team may use the information provided to reach out to you.
    2. We may use your Personal Information to send you updates about our firm, information regarding our services or practice areas, and at times, updates regarding changes in laws or regulations that might be relevant to you.
    3. We may use Usage Information to improve our Website.
    4. We may use your information to resolve disputes, troubleshoot problems, and enforce our agreements with you.  
    5. We may use your information for any other specific purpose that we communicate to you upon collection of the same, and for any purpose that you approve or for which you direct us to use such information.
    6. If you submit sensitive Personal Information as part of a job application, we will use such information only to evaluate your application (and if you are hired, for onboarding or general employee records purposes as allowable or required by law).
  5. Disclosure of Your Information. We will not sell your Personal Information. We may disclose and share information as set forth below.  
    1. We may share your information with our service providers, and other third parties who we have engaged in order to continue to develop and improve our Website. For example, we may disclose your information to IT service providers, such that they may support our IT systems, provide hosting, processing, and analyzing services with respect to information and data collected, and provide maintenance of such systems, or on the basis of other legitimate interests.  
    2. We may share your information as part of a transfer or assignment if we are acquired by, sold to, or merged with another entity, or otherwise reorganized or liquidated.  
    3. We may share information to enforce other agreements with you, and if we believe disclosure is necessary or appropriate to investigate, prevent, or take action regarding illegal activities, suspected fraud, unauthorized use of third party rights, situations involving potential threats to the physical safety of any person, violations of this Policy, and as otherwise required or permitted by law or consistent with legal requirements.
    4. We may also disclose your information for any other specific purpose that we communicate to you upon collection of the same, and for any purpose that you approve or for which you direct us to use such information.
  6. SMS and Text. We may offer the option of providing your phone number to us, including if you reach out to us through the Website or if you contact one of our team members directly. As of the date of this Policy, we do not plan to text you. However, if you text us, or any of our team members, you are choosing to opt-in to texting and may receive an automated response. We will not share your phone number with any third party (except as described in Section 5). This is not a recurring text message program or campaign, and you will not receive further texts from us; however, you may opt-out of texting at any time by (i) responding STOP in response to any message from us, or (ii) reaching out via email to info@gutweinlaw.com to request that we remove your phone number from our text list. You are solely responsible for understanding whether your carrier charges you for texts, and you accept all such charges for our automated response if you choose to text us.
  7. Use Restrictions. Users of the Website shall not (i) use the Website in any manner that damages, disables, overburdens, or impairs the Website; (ii) scrape information, data, or content made available through the Website, by any means, manually or through a software program; or (iii) lease, distribute, license, transfer, sell, or otherwise commercially exploit our services or your access to the same. Further, you acknowledge and agree that the content on the Website, as between Gutwein Law and users of the Website, is the property of Gutwein Law. You are prohibited from downloading or otherwise attempting to copy the content on the Website.
  8. Security of Information. We cannot guarantee that 100% of data transmissions are secure. Therefore, while we strive to protect your Personal Information, you acknowledge that: (i) there are limitations to security and privacy of the internet that are beyond our control; (ii) the security, integrity and privacy of the Personal Information exchanged between you and us cannot be guaranteed; and (iii) any information and data may be viewed or tampered with in transit by a third party.
  9. Consent Revocation and Opt-Out; Retention. To the extent we rely on your consent to process any information, you may revoke that consent at any time. If you wish to revoke such consent, or if at any time you do not wish to receive the communications stated herein from Gutwein Law, you may do so by sending your request to us by email at info@gutweinlaw.com. It may take up to ten days for the change to be fully effective. Notwithstanding the foregoing, we may continuously maintain Usage Data. Unless and until you opt-out, we will retain your Personal Information for only the period required to provide the requested services to you, except (i) as otherwise required or allowable by law; (ii) Personal Information retained for marketing communications may be retained indefinitely until you opt out, and (iii) client information will be retained pursuant to our file retention policy (available upon request).
  10. Third-Party Services. This document only addresses the use and disclosure of information that we obtain from you directly. Other sites accessible through our Website from time to time may have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s policies. We are not responsible for the policies or practices of third parties. You should contact those third parties directly if you have any questions about their policies and practices regarding your information.
  11. Age and Location. This Website is directed only to users over the age of 18 who are residents of the United States. We do not knowingly collect Personal Information from individuals under the age of 18. If you access the Website from outside of the United States, you do so at your own risk and you are responsible for compliance with all local laws and regulations.
  12. Governing Law. These Terms and your access to our Website shall be governed by, construed, and enforced in accordance with the laws of the State of Indiana without giving effect to the conflicts or choice of law provisions thereof. Any action or proceeding seeking to enforce any provision of, or based upon any right arising out of, these Terms shall be brought in any court of appropriate jurisdiction in Tippecanoe County, Indiana.
  13. Your Rights Under US State Laws. In the United States, depending on your state of residence, and subject to certain exceptions, you may have some or all of the following rights: 
    1. Right to Know: The right to request that we disclose to you the Personal Information we collect, use, or disclose, and to access the same.
    2. Right to Request Correction: The right to request that we correct inaccurate Personal Information that we maintain about you.
    3. Right to Request Deletion: The right to request that we delete Personal Information that we have collected from or about you. Note that if you are a client of our firm, we may not be able to delete your Personal Information if you desire to remain a client.
    4. Right to Portability: The right to obtain a copy of your Personal Information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller. 
    5. Right to Opt Out: The right to opt out of the processing of your Personal Information for purposes of targeted advertising and profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

To submit a request to exercise your rights set forth in this Section 13, and as applicable, to appeal a consumer rights action, you may use info@gutweinlaw.com. We may require that you verify your identity to respond to your request. If you are entitled to a substantive response, we will deliver the requested information to you within 45 days (or will inform you that an extension of such timeframe is necessary). You may make a request up to twice during a 12-month period. We will not discriminate against you for exercising your rights pursuant to applicable state laws. In certain states you have the right to designate an authorized agent to submit requests on your behalf.
